    So do you address/discuss standard of care in the whilst analyzing the duty element or following the introduction of the following element (breach). @ 10:48 this becomes a little unclear because duty means you owe someone a standard of care and breach is when you fail to achieve that standard of care. - Thanks for the videos, I've found them very helpful.

    In a negligence analysis on a torts essay, you should identify what the applicable standard of care is under your analysis of of the duty element. Next, you would discuss whether the defendant met that standard of care under your analysis of the breach element.

    DUTY

    Your duty analysis is 2 steps: (1) Determine whether the defendant owed the plaintiff a duty of care under both Palsgraf approaches; and (2) If you determine that the defendant owed the plaintiff a duty of care, next you must determine what standard of care the defendant owed the plaintiff (e.g., reasonable person, physician, child, etc.).

    For example, your conclusion of your analysis of the duty element might sound like: ". . . Ultimately, Dave owed Pam a duty to conform his conduct to the reasonable person standard of care, because _____."

    BREACH

    If you determine that the defendant owed the plaintiff a duty to conform his conduct to a specific standard of care, then you are ready to discuss breach. Under your analysis of breach, you must determine whether the defendant's conduct met the standard of care owed to the plaintiff.

    For example, your conclusion of your analysis of the breach element might sound like: ". . . Ultimately, Dave breached the duty of care that he owed Pam, because he failed to act as a reasonably prudent person would under like circumstances as measured by an objective standard."
