they probably got permission from When In Rome's publisher or the actual owner of the song. there was probably a contract drawn up on the agreement as statutory royalty fees would have to be paid. Or I could just be making this shit up.

The two songs are completely unrelated with completely different lyrics. Listen to the lyrics, for example. "The Promise" is about someone saying to someone they love that they'll be there for them no matter what happens. "Rose Garden" is about someone saying that they're in love with someone but saying that nothing will be perfect all the time. In addition, the song you're describing more closely describes "I Beg Your Pardon" by Kon Kan, which samples the song.
